TERMS & CONDITIONS – SOL-OBSCURA FESTIVAL

Before purchasing, please note:
Organizer: Ticket sales currently operated by DEEPBRASSLAB Ltd (UK). Operational responsibility will be transferred to a Spanish Sociedad Limitada (S.L.) prior to the Event.
Age Policy: All ages welcome. Under 18s must be accompanied by a parent or legal guardian. Children under 12 enter free (no ticket required). Valid photo ID may be required.
Tickets: Non-refundable. Personalisation required.
Resale: Commercial resale is strictly prohibited. Transfers only via authorised channels.
Refunds: Tickets are non-refundable except in cases of cancellation or rescheduling, subject to these Terms.
Accessibility: Advance requests via deepbrasslab@gmail.com. Companion tickets assessed case-by-case.
Fire Ban: Strict prohibition on open fires, charcoal grills, and pyrotechnics due to high wildfire risk in Spain.
Cashless: The Event may operate a cashless payment system for food and drinks.
1. SCOPE, CONTRACTUAL PARTNERS & ASSIGNMENT
1.1 Contracting Party
The contract for the purchase of tickets is initially concluded with:

1.2 Assignment to Event Operator
The participant acknowledges that the operational execution of SOL-OBSCURA will be carried out by a Spanish legal entity (Sociedad Limitada – S.L.), currently in formation.
1.3 Transfer of Contract
DEEPBRASSLAB Ltd reserves the right to assign all rights and obligations arising from this contract to the Spanish S.L. prior to the Event. By purchasing a ticket, the participant expressly consents to this transfer. Participants will be notified once the transfer is completed.
1.4 House Rules
These Terms apply together with all on-site House Rules and mandatory regulations of Spanish local authorities.
2. AGE RESTRICTION & IDENTIFICATION
2.1 Age Policy
SOL-OBSCURA is open to all ages. Participants under 18 must be accompanied at all times by a parent or legal guardian holding a valid ticket. Children under 12 do not require a ticket but must remain accompanied at all times.
2.2 Identification
Tickets are personalised. Valid photo ID may be requested. Accepted forms include passports, Spanish DNI or NIE, or EU/EEA national ID cards. Copies or expired documents are not accepted.
2.3 Refusal of Entry
Failure to present valid identification or the presence of unaccompanied minors may result in refusal of entry without refund.
2.4 Alcohol
Alcohol will not be sold or served to persons under 18, in accordance with Spanish law.
3. TICKETS, RESALE & REFUNDS
3.1 Personalisation
Tickets are personalised and non-transferable except through authorised channels.
3.2 No Commercial Resale
Commercial resale is strictly prohibited. Tickets sold via unauthorised platforms may be cancelled without compensation.
3.3 Authorised Transfers
Private transfers are permitted only via platforms or processes authorised by the Organizer. A transfer fee may apply.
3.4 No Right of Withdrawal
Ticket purchases relate to leisure events on a specific date and are excluded from statutory cancellation rights where permitted by law.
3.5 Refund Policy
Tickets are non-refundable except where required by mandatory law.
If the Event is cancelled (excluding Force Majeure), ticket holders will be offered a refund of the ticket face value.
Handling or administration fees may be non-refundable if already incurred.
If the Event is rescheduled, tickets remain valid. Refund requests may be submitted within 30 calendar days of the new date announcement.
Minor programme changes, artist cancellations, schedule adjustments, adverse weather, or Force Majeure interruptions do not entitle ticket holders to refunds.
Variations in eclipse visibility, duration, angle above the horizon, obstruction by natural terrain, or weather conditions shall not be considered cancellation, non-performance, or material alteration of the Event.
4. WRISTBANDS & ADMISSION
Tickets must be exchanged for wristbands on first entry.
Wristbands must be worn intact at all times.
Damaged or removed wristbands are invalid.
Lost wristbands are generally not replaced.
The Organizer reserves the right to refuse entry or remove individuals breaching these Terms or posing a safety risk.
5. PROHIBITED ITEMS
The following are prohibited:
Open flames, grills, generators, pyrotechnics
Weapons or dangerous items
Illegal substances and nitrous oxide canisters
Glass containers (except small cosmetics in camping areas)
Large sound systems
Drones
Professional recording equipment without accreditation
Oversized bags in stage areas
Confiscated items will not be returned.
6. CAMPING, FIRE SAFETY & ENVIRONMENT
6.1 Camping at Own Risk
Camping is at the participant’s own risk. The Organizer accepts no liability for loss, theft, or damage.
6.2 TOTAL FIRE BAN
Due to extreme wildfire risk, open fires, candles, charcoal grills, and sky lanterns are strictly prohibited. Gas cookers are permitted only if authorised by local authorities.
6.3 Environmental Responsibility
Participants must leave no trace and remove all belongings and waste. A deposit system may apply.
6.4 Vehicles
Sleeping in vehicles is permitted only in designated camper areas.
7. SOLAR ECLIPSE SAFETY & VISIBILITY
7.1 Safety Warning
Looking directly at the sun outside totality can cause permanent eye damage.
7.2 Eye Protection
Only ISO 12312-2 certified eclipse glasses provide adequate protection. Regular sunglasses are not sufficient.
7.3 Totality Viewing
Viewing without eye protection is safe only during totality.
7.4 Eclipse Timing, Angle & Visibility Disclaimer
Partial eclipse begins at approximately 19:36, sun altitude ~15°
Totality occurs at approximately 20:31, sun altitude ~4°, lasting up to 1m33s
Partial eclipse ends at approximately 20:55
Due to surrounding mountainous terrain, the sun will pass behind the mountain at approximately 2.7° altitude and will no longer be visible from the Event site. Visibility duration may therefore be shorter than official astronomical timings and may vary across the site.
Weather conditions are beyond the Organizer’s control and may partially or fully obstruct visibility.
The occurrence of the eclipse itself is astronomically certain; however, visibility, duration, clarity, and viewing conditions are not guaranteed.
8. HEALTH, SAFETY & WELFARE
Medical and welfare services will be available.
Sound levels may exceed 85 dB; hearing protection is recommended.
Participants must prepare for extreme heat, sun exposure, dust, and uneven terrain.
9. ACCESSIBILITY
The Organizer aims to make SOL-OBSCURA as accessible as reasonably possible. Requests should be submitted in advance to deepbrasslab@gmail.com. Companion tickets are assessed case-by-case.
10. CASHLESS PAYMENT
The Event may operate a cashless payment system. Refund terms for remaining balances will be published prior to the Event.
11. MEDIA & RECORDING
By attending, participants consent to photography and filming for promotional and documentary use. Professional recording requires prior written permission.
12. LIABILITY
Unlimited liability applies for injury to life, body, or health.
Other liability is limited to intent and gross negligence, except where mandatory law applies.
No liability is accepted for weather conditions, lost property, or injuries resulting from failure to follow safety instructions.
13. DATA PROTECTION
Personal data is processed by DEEPBRASSLAB Ltd and, following assignment, by the Spanish S.L., in accordance with UK GDPR and EU GDPR.
14. COMPLAINTS & DISPUTE RESOLUTION

EU consumers may access the EU Online Dispute Resolution platform where applicable.
15. GOVERNING LAW & JURISDICTION
Until assignment, these Terms are governed by the laws of England and Wales.
On-site operations are subject to mandatory Spanish law.
Following assignment, jurisdiction may shift to Spain, subject to consumer protection laws.
16. AMENDMENTS
The Organizer may update these Terms. Material changes will be communicated to ticket holders.
